On September 23, 2008, Michael Del Grande (the “Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated August 22, 2008, to approve the partial wind up report dated August 2007, filed in respect of the Pension Plan for Executives of Shoppers Drug Mart, Registration Number 1066083, (the “Plan”) under section 70(2) of the PBA, subject to certain limitations.

Requests for hearing were also filed by Morrie Cohen, Gerry Goskopf, Diane Hindman, William Dingwall, Russell Cohen, John Taylor, Howard Kopstick, Stanley Thomas, Eddie Mainiero and Michael Hoenmans.

An application for party status was filed by Shoppers Drug Mart Inc.

On December 8, 2008, an application for party status was filed by Greg Harmeson. On December 15, 2008 John Taylor, Stanley Thomas and Russell Cohen withdrew their respective requests for hearing.

At the pre-hearing conference on December 16, 2008 full party status was granted to Greg Harmeson.  The parties agreed to participate in settlement discussions and a settlement conference is scheduled for February 18, 2009.  Hearing dates were scheduled for April 24, 27, and June 22-24, 2009 in the event the matter does not settle.

On April 24 and 27, 2009 at stage one of these proceedings, the Tribunal heard evidence and legal submissions from some of the parties on (a) whether Mr. Cohen and Mr. Del Grande were members of the Plan; (b) whether Mr. Hoenmans and Mr. Harmeson are entitled to grow-in benefits;
and (c) what remedies are Mr. Mainiero and Mr. Groskopf entitled to in the proceeding. The Tribunal reserved its decision.  Stage two of these proceedings is scheduled to be heard on June 22-24, 2009.
