On July 22, 2008, Abitibi-Consolidated Inc., the “Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated June 27, 2008, to refuse to consent to transfers of assets effective January 1, 1998, from the Stone Salaried Plan and the Abitibi Non-Union Plan to the Stone Non-Union Plan under section 81 of the PBA. A pre-hearing conference is scheduled for November 3, 2008.Updated to August 8, 2008 A pre-hearing conference was scheduled for November 3, 2008 and was subsequently rescheduled to March 2, 2009, at the request of the parties in order to permit time for the Applicant to locate missing documentation. Updated to September 12, 2008 On January 26, 2009, the Applicant reported to the Tribunal on the progress made in its efforts to locate the missing documentation. On consent of the parties the Applicant requested a further adjournment of the pre-hearing conference to permit additional time while such efforts continue.
