On February 8, 2008, Henry Kernius, a former member of the Plan (the “Applicant”), requested a hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated January 8, 2008, to propose to make an Order pursuant to section 87(2)(a) of the PBA, that the Ontario Power Generation Inc. commence payment of the pension of Henry Kernius together with all interest on outstanding payments from the date such payments were due to the date of payment. On February 11, 2008 a request for hearing was also filed by the Ontario Power Generation Inc. On February 25, 2008, an application for party status was filed by Lenore Edmunds, the former spouse of Henry Kernius. A pre-hearing conference is scheduled for May 9, 2008. Updated to March 25, 2008 At the pre-hearing conference on May 9, 2008, full party status was granted to Lenore Edmunds. A settlement conference is scheduled for July 4, 2008, and a hearing will be scheduled in December 2008 in the event the matter does not settle. Updated to May 9, 2008 On July 4, 2008, the parties settled the matter and requested a resumption of the pre-hearing conference on July 8, 2008 for the purpose of requesting an Order of the Tribunal incorporating the Minutes of Settlement.
