On December 13, 2006, Unilever Canada Inc.(the “Applicant”) requested a hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated  November 9, 2006, proposing to make an order, pursuant to s. 87 of the Pension Benefits Act (the “Act”), that the pension benefit for Mr. Douglas Wills be recalculated under the terms of the Plan.  The Applicant had maintained that the pension benefit had been calculated in accordance with the terms of the Plan but for a sub-clause that was in the Plan as a result of a drafting error, but the Deputy Superintendent had concluded that the Applicant had not provided adequate evidence or reasons to demonstrate that there was a basis for rectification of the terms of the Plan so as to eliminate this sub-clause. 

On December 19, 2006, an application for party status was filed by Mr. Douglas Wills.

A pre-hearing conference is scheduled for March 27, 2007.

On January 29, 2007, the parties requested an adjournment of the pre-hearing conference on consent to allow time for settlement discussions.  The Tribunal granted the request for adjournment and the pre-hearing was rescheduled to April 23, 2007, for the purpose of updating the Tribunal on the progress of the settlement discussions in the event the matter does not settle by that date.

On April 19, 2007, the Applicant withdrew its Request for Hearing and advised the matter was settled pursuant to minutes of settlement.  The Tribunal cancelled the pre-hearing conference scheduled for April 23, 2007 and closed its file.
