On June 29, 2001, Crown Cork & Seal Canada Inc. requested a hearing with respect to the Superintendent’s Notice of Proposal dated May 29, 2001, to refuse to consent to a transfer of assets proposed by Crown Cork & Seal Canada Inc. from the Crown Cork & Seal Canada Inc. Pension Plan for Salaried Employees, Registration Number 0474205, and the Pension Plan for Clerical Employees of Crown Cork & Seal Canada Inc., Registration Number 0595371, into the Crown Cork & Seal Canada Inc. Pension Plan for Employees, Registration Number 0338491. The basis for the refusal is that the asset transfer does not protect the pension benefits and other benefits of the members and former members of the Plans. At the request of both parties a settlement conference was held on October 30, 2001, prior to the scheduling of a pre-hearing conference. At the settlement conference the parties agreed to adjourn the matter sine die pending discussions between the parties. On February 11, 2003, counsel for the Superintendent requested a pre-hearing conference be scheduled as the parties were unable to resolve the issues in this matter. At the pre-hearing conference on May 12, 2003, the parties stated they would contact the Registrar to resume the pre-hearing conference if they did not resolve the issues at a settlement meeting on May 26, 2003. On June 20, 2003, the parties advised that they expect the settlement discussions to continue. Updated to May 31, 2006 On June 5, 2006, the Tribunal issued to Updated to August 21, 2006 On October 5, 2006, the parties requested an adjournment of the October 12 pre-hearing conference date to provide the Superintendent with adequate time to review and consider submissions filed by the Applicant and to complete their settlement discussions. The adjournment request was granted and the pre-hearing conference is now scheduled for January 9, 2007. Updated to October 6, 2006 On January 3, 2007, the parties advised that the Superintendent was still reviewing the submissions filed by the Applicant and that a further adjournment of the pre-hearing conference was necessary. The adjournment was granted and the pre-hearing is rescheduled to April 5, 2007. Updated to January 10, 2007 On March 29, 2007, the parties requested a further adjournment of the pre-hearing conference as more time is required for the Superintendent to review the submissions filed by the Applicant. The Tribunal granted the request for adjournment and rescheduled the pre-hearing conference to June 26, 2007. Updated to April 2, 2007 On June 19, 2007, the parties requested an adjournment of the pre-hearing conference, scheduled for June 26, 2007, to permit the Applicant time to review and respond to a recent letter of the Superintendent.
